Terms of Service

These Terms of Service ("Terms") govern Your access to and use of Crewcial Draft (the "Service"), provided by Crewcial Draft LLC ("Company", "We", "Us", or "Our"), a Texas limited liability company. By creating an account or otherwise accessing or using the Service, You agree to be bound by these Terms and by Our Privacy Policy. If You do not agree to these Terms, do not use the Service.

1. Eligibility

You must be at least 18 years old (or the age of majority in Your jurisdiction, if higher) to create an account or use the Service. The Service is not intended for, and may not be used by, anyone under the age of 18. By using the Service, You represent and warrant that You meet this requirement and that the information You provide is accurate.

2. Description of the Service

Crewcial Draft is a fantasy sports platform for creating and managing leagues, conducting drafts, tracking scoring, and communicating with other participants across web, mobile, and desktop. The Service is provided for entertainment purposes only.

3. No Real-Money Gaming, Entry Fees, or Prizes

The Service does not offer, facilitate, or support any form of gambling, wagering, real-money gaming, paid entry, or cash or merchandise prizes. We do not collect entry fees, and We do not award prizes of monetary value. The Service is not a sportsbook, a daily fantasy sports contest operator, or a money-transmission service. Any contest, draft, or competition conducted through the Service is for entertainment and bragging rights only. You are solely responsible for any arrangements You make with other users outside of the Service, and We are not a party to, and accept no responsibility for, any such arrangements.

4. Accounts and Registration

To use most features of the Service, You must create an account. You may register or sign in using a supported third-party login service (currently Discord, Apple, or Yahoo). You are responsible for maintaining the confidentiality of Your account credentials and for all activity that occurs under Your account. You agree to provide accurate information, to keep it up to date, and to notify Us promptly of any unauthorized use of Your account. We may suspend or terminate accounts that violate these Terms.

5. License to Use the Service

Subject to Your compliance with these Terms, We grant You a limited, non-exclusive, non-transferable, revocable license to access and use the Service for Your personal, non-commercial use. You may not copy, modify, distribute, sell, lease, reverse engineer, or attempt to extract the source code of the Service, except to the extent that such restrictions are prohibited by applicable law.

6. User Content

The Service allows You to create and share content, including chat messages, direct messages, team names, league configurations, and rankings ("User Content"). You retain ownership of Your User Content. By submitting User Content, You grant Us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, and transmit that User Content as necessary to operate and provide the Service. You are solely responsible for Your User Content and represent that You have the necessary rights to it and that it does not violate these Terms or any applicable law. We do not pre-screen User Content, but We reserve the right to review, remove, or restrict any User Content at Our discretion.

7. Acceptable Use

When using the Service, You agree that You will not:

Violate any applicable law or regulation;
Post or transmit content that is unlawful, harassing, defamatory, abusive, threatening, hateful, obscene, or otherwise objectionable;
Impersonate any person or entity, or misrepresent Your affiliation with a person or entity;
Harass, bully, threaten, or harm other users, including through chat or direct messages;
Upload viruses or malicious code, or otherwise attempt to disrupt, degrade, or gain unauthorized access to the Service or its infrastructure;
Use bots, scrapers, or other automated means to access the Service beyond what a human could reasonably produce, except as expressly permitted by Us;
Use the Service to facilitate any form of gambling, wagering, or real-money gaming; or
Infringe the intellectual property or other rights of any third party.

8. Third-Party Services and Integrations

The Service integrates with third-party services, including Discord, Apple, and Yahoo for sign-in and league import, and relies on third-party sports data and infrastructure providers. Your use of those services is governed by their own terms and privacy policies. We do not control and are not responsible for third-party services, and We do not guarantee the accuracy, availability, or continued operation of any third-party integration or data feed.

9. Intellectual Property

The Service and its original content (excluding User Content), features, and functionality are and will remain the exclusive property of the Company and its licensors, and are protected by copyright, trademark, and other laws. Team names, logos, and other sports-related marks referenced within the Service are the property of their respective owners, and their use within the Service does not imply any affiliation or endorsement.

10. Privacy

Your use of the Service is also governed by Our Privacy Policy, which explains how We collect, use, and disclose Your information. By using the Service, You consent to the practices described in the Privacy Policy.

11. Termination

You may stop using the Service and delete Your account at any time using the "Delete Account" option in Your settings or via our Account Deletion page. We may suspend or terminate Your access to the Service at any time, with or without notice, if We believe You have violated these Terms or to protect the Service or its users. Sections that by their nature should survive termination (including ownership provisions, disclaimers, limitations of liability, and dispute resolution) will survive.

12. Disclaimers

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, secure, or error-free, or that any sports data, scores, projections, or statistics provided through the Service are accurate, complete, or current. You use the Service, and rely on any such data, at Your own risk.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE COMPANY OR ITS DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO Your USE OF, OR INABILITY TO USE, THE SERVICE. BECAUSE THE SERVICE IS PROVIDED FREE OF CHARGE, OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US$100). Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above may not apply to You.

14. Indemnification

You agree to defend, indemnify, and hold harmless the Company and its officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from: (a) Your use of the Service; (b) Your User Content; (c) Your violation of these Terms; or (d) Your violation of any rights of a third party.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, United States, without regard to its conflict of law provisions.

16. Dispute Resolution and Arbitration

Before filing any claim, You agree to first contact Us at support@crewcialdraft.com and attempt to resolve the dispute informally. If We cannot resolve a dispute within sixty (60) days, any dispute arising out of or relating to these Terms or the Service that cannot be resolved informally shall be resolved by binding arbitration on an individual basis, conducted in the State of Texas, except that either party may bring a claim in small-claims court where eligible. To the extent permitted by law, You and the Company agree to waive any right to participate in a class action or class-wide arbitration. This section does not prevent either party from seeking injunctive relief in court for the unauthorized use of intellectual property.

17. Changes to These Terms

We may modify these Terms from time to time. If We make material changes, We will provide notice by posting the updated Terms on this page and updating the "Last updated" date, and, where appropriate, by notifying You through the Service or by email. Your continued use of the Service after the changes become effective constitutes Your acceptance of the revised Terms.

18. Miscellaneous

These Terms, together with the Privacy Policy, constitute the entire agreement between You and the Company regarding the Service and supersede any prior agreements. If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision will not be considered a waiver of those rights. You may not assign or transfer these Terms without Our prior written consent, but We may assign these Terms without restriction.
